Employment Act

<p>The Employment Act (Cap 226) is Uganda's main law governing relationships between employers and employees. It protects most workers who have a contract of service, setting minimum standards for wages, working hours, leave, and termination. The Act also prohibits forced labour and discrimination, establishes labour officers to enforce the law, and provides remedies for unfair dismissal. Whether you are an employee or employer, this Act defines your basic rights and obligations.</p>

<h3>Who Is Covered by the Act</h3>
<p>The Act applies to all employees working under a <strong>contract of service</strong>, including casual, seasonal, and migrant workers. However, it does not cover:</p>
<ul>
<li>Very small family businesses with up to five dependent relatives working for the family</li>
<li>Members of the Uganda People's Defence Forces (UPDF), except civilians working for the military</li>
<li>Work performed outside Uganda (unless the Act specifically says otherwise)</li>
</ul>

<h3>Key Definitions</h3>
<p>Important terms under the Act include:</p>
<ul>
<li><strong>Employee</strong> – any person who works under a contract of service</li>
<li><strong>Employer</strong> – any person or organisation that employs others under a contract of service</li>
<li><strong>Wages</strong> – all remuneration payable to an employee for work done</li>
<li><strong>Child</strong> – anyone under 18 years of age</li>
<li><strong>Forced labour</strong> – any work or service extracted under threat or coercion</li>
<li><strong>Casual employee</strong> – one whose employment is not continuous</li>
<li><strong>Migrant worker</strong> – a person who works outside their home country</li>
</ul>

<h3>Prohibition of Forced Labour</h3>
<p>The Act explicitly bans any form of <strong>forced or compulsory labour</strong>. Exceptions include military service, civic duties, court-ordered work under public supervision, and emergency work during war or natural disasters. Violators face fines of up to 48 currency points or up to two years in prison, or both, plus daily fines for continuing violations.</p>

<h3>Non-Discrimination and Equal Pay</h3>
<p>Employers cannot discriminate against employees based on race, colour, sex, religion, political opinion, national origin, social background, HIV status, or disability. Women and men are entitled to <strong>equal pay for work of equal value</strong>. The government must actively promote equal opportunities, including for legally present migrant workers.</p>

<h3>Sexual Harassment</h3>
<p>You have the right to a workplace free from sexual harassment. It is illegal for an employer or manager to demand sexual favours in exchange for job benefits, or to engage in unwelcome sexual conduct that harms your work. If you experience harassment, you may complain to a <strong>labour officer</strong> who can order remedies similar to those for unfair dismissal. Employers with more than 25 workers must have measures to prevent sexual harassment.</p>

<h3>Labour Officers and Enforcement</h3>
<p>The government has set up the Directorate of Labour, with a <strong>Commissioner</strong> and <strong>district labour officers</strong>, to enforce the Act. Labour officers can inspect any workplace without warning, question employees, check documents, and even close a workplace if there is immediate danger. They are also responsible for investigating complaints, mediating disputes, and prosecuting offences. Obstruction of a labour officer is a criminal offence.</p>

<h3>Employment Contracts</h3>
<p>Contracts can be oral or written, but certain details must be given in writing within 12 weeks of starting work (job title, pay, hours, leave, notice period). If you cannot read the contract language, it must be attested by a magistrate or labour officer. No contract can take away rights granted by the Act – any such term is invalid. Your contract cannot be transferred to a new employer without your consent, unless the business itself is sold.</p>

<h3>Wages and Payment</h3>
<p>Wages must be paid in cash (legal tender) unless you agree in writing to cheque or direct deposit. You cannot be forced to spend your wages at your employer's shop. Payment must be made at regular intervals – daily, weekly, fortnightly, or monthly – and within <strong>seven days</strong> after your employment ends. Only you (or someone you authorise in writing) can receive your wages.</p>

<h3>Working Hours and Overtime</h3>
<p>The standard workweek is <strong>48 hours</strong> (maximum 10 hours per day, 56 per week with agreement). If you work more than 8 hours a day or 48 hours a week, overtime is paid at <strong>1.5 times</strong> your normal rate on regular days and <strong>double</strong> on public holidays. You are entitled to a 30-minute break if your normal workday is at least 8 hours.</p>

<h3>Annual Leave, Sick Leave, Maternity and Paternity Leave</h3>
<ul>
<li><strong>Annual leave:</strong> 7 days after every 4 months of continuous service, with full pay. You cannot waive this right.</li>
<li><strong>Public holidays:</strong> You get them off with full pay; if you work, you get double pay.</li>
<li><strong>Sick leave:</strong> After one month of service, you are entitled to full pay for the first month of sickness. You must notify your employer and provide a medical certificate if requested.</li>
<li><strong>Maternity leave:</strong> Female employees get <strong>60 working days</strong> with full pay. At least 4 weeks must be taken after childbirth or miscarriage. You can return to the same or equivalent job.</li>
<li><strong>Paternity leave:</strong> Male employees get <strong>4 working days</strong> with full pay after the birth of a child or after a miscarriage.</li>
</ul>

<h3>Termination of Employment</h3>
<p>Your employment can end by notice, expiry of a fixed-term contract, resignation, or summary dismissal (for gross misconduct). The Act sets minimum <strong>notice periods</strong> based on length of service:</p>
<ul>
<li>6 months to 1 year: 2 weeks</li>
<li>1 to 5 years: 1 month</li>
<li>5 to 10 years: 2 months</li>
<li>10 years or more: 3 months</li>
</ul>
<p>Notice must be in writing and in a language you understand. You can accept payment instead of working the notice period.</p>

<h3>Unfair Dismissal and Compensation</h3>
<p>You have the right to challenge an unfair dismissal if you have worked for at least <strong>13 weeks</strong>. A dismissal is unfair if it is based on discrimination, pregnancy, union membership, filing a complaint, or if the employer failed to follow fair procedures. You must first complain to a labour officer within <strong>three months</strong>. If successful, you are entitled to at least <strong>four weeks' wages</strong>, plus up to three months' extra compensation depending on your circumstances.</p>

<h3>Severance Allowance</h3>
<p>You qualify for severance if you have worked continuously for at least <strong>six months</strong> and are unfairly dismissed, die while employed, become physically incapacitated, or your employer becomes bankrupt. The amount is negotiated between you and your employer (or through your union). If your employer deliberately refuses to pay, they face a fine of double the amount owed, paid to you.</p>

<h3>Disciplinary Procedures</h3>
<p>Your employer can give written warnings, reprimands, or suspension (up to 15 days in any 6-month period) as discipline, but only if it is reasonable. Before any dismissal, you have the right to be told the reasons in a language you understand, to bring another person to the hearing, and to have your side heard. If the procedure is not followed, you are entitled to <strong>four weeks' net pay</strong>.</p>

<h3>Rights of Vulnerable Workers</h3>
<ul>
<li><strong>Children:</strong> No child under 12 may work. Children under 14 may only do light work that does not affect schooling. Hazardous work and night work (7pm–7am) are banned for all children.</li>
<li><strong>Medical exams:</strong> Workers in hazardous jobs must undergo a medical check before starting and periodically thereafter. Results are confidential.</li>
<li><strong>Disabled workers:</strong> The Minister must make special regulations to protect their safety and fair treatment.</li>
</ul>

<h3>Complaints and Dispute Resolution</h3>
<p>If your rights under the Act are violated, you must first file a complaint with a <strong>labour officer</strong>. The officer will try to settle the matter through conciliation or mediation. If no decision is made within 90 days, you can take your case to the <strong>Industrial Court</strong>. Appeals from a labour officer's decision go to the Industrial Court on questions of law (and sometimes on facts with permission). The Industrial Court's decision is final. You can be represented by a lawyer, a union official, or an employer's organisation representative.</p>

If your employer fires you, they must prove the reason for your dismissal. If they cannot provide a valid reason, the law considers your dismissal unfair. The reason must be one your employer genuinely believed existed at the time. The written explanation your employer gave you (as required by Section 60) will be used to decide if the employer has met this requirement.

Employer must prove reason for dismissal under Section 67. Failure leads to unfair dismissal. The reason must be genuinely believed. Certificate of reasons (Section 60) considered.

Section 67: Proof of Reason for Termination in Uganda

In any claim arising out of termination, the employer shall prove the reason or reasons for the dismissal, and where the employer fails to do so, the dismissal shall be deemed to have been unfair within the meaning of <span class="underline-gradient ref-link" data-ref="226:70">section 70</span>.

The reason or reasons for dismissal shall be matters, which the employer, at the time of dismissal, genuinely believed to exist and which caused him or her to dismiss the employee.

In deciding whether an employer has satisfied this section, the contents of a certificate such as is referred to in <span class="underline-gradient ref-link" data-ref="226:60">section 60</span> informing the employee of the reasons for termination of employment shall be taken into account.
