An Act to provide for the laws governing individual employment relationships and to provide for related matters.

Employment Act

<p>The Employment Act (Cap 226) is Uganda's main law governing relationships between employers and employees. It protects most workers who have a contract of service, setting minimum standards for wages, working hours, leave, and termination. The Act also prohibits forced labour and discrimination, establishes labour officers to enforce the law, and provides remedies for unfair dismissal. Whether you are an employee or employer, this Act defines your basic rights and obligations.</p>

<h3>Who Is Covered by the Act</h3>
<p>The Act applies to all employees working under a <strong>contract of service</strong>, including casual, seasonal, and migrant workers. However, it does not cover:</p>
<ul>
<li>Very small family businesses with up to five dependent relatives working for the family</li>
<li>Members of the Uganda People's Defence Forces (UPDF), except civilians working for the military</li>
<li>Work performed outside Uganda (unless the Act specifically says otherwise)</li>
</ul>

<h3>Key Definitions</h3>
<p>Important terms under the Act include:</p>
<ul>
<li><strong>Employee</strong> – any person who works under a contract of service</li>
<li><strong>Employer</strong> – any person or organisation that employs others under a contract of service</li>
<li><strong>Wages</strong> – all remuneration payable to an employee for work done</li>
<li><strong>Child</strong> – anyone under 18 years of age</li>
<li><strong>Forced labour</strong> – any work or service extracted under threat or coercion</li>
<li><strong>Casual employee</strong> – one whose employment is not continuous</li>
<li><strong>Migrant worker</strong> – a person who works outside their home country</li>
</ul>

<h3>Prohibition of Forced Labour</h3>
<p>The Act explicitly bans any form of <strong>forced or compulsory labour</strong>. Exceptions include military service, civic duties, court-ordered work under public supervision, and emergency work during war or natural disasters. Violators face fines of up to 48 currency points or up to two years in prison, or both, plus daily fines for continuing violations.</p>

<h3>Non-Discrimination and Equal Pay</h3>
<p>Employers cannot discriminate against employees based on race, colour, sex, religion, political opinion, national origin, social background, HIV status, or disability. Women and men are entitled to <strong>equal pay for work of equal value</strong>. The government must actively promote equal opportunities, including for legally present migrant workers.</p>

<h3>Sexual Harassment</h3>
<p>You have the right to a workplace free from sexual harassment. It is illegal for an employer or manager to demand sexual favours in exchange for job benefits, or to engage in unwelcome sexual conduct that harms your work. If you experience harassment, you may complain to a <strong>labour officer</strong> who can order remedies similar to those for unfair dismissal. Employers with more than 25 workers must have measures to prevent sexual harassment.</p>

<h3>Labour Officers and Enforcement</h3>
<p>The government has set up the Directorate of Labour, with a <strong>Commissioner</strong> and <strong>district labour officers</strong>, to enforce the Act. Labour officers can inspect any workplace without warning, question employees, check documents, and even close a workplace if there is immediate danger. They are also responsible for investigating complaints, mediating disputes, and prosecuting offences. Obstruction of a labour officer is a criminal offence.</p>

<h3>Employment Contracts</h3>
<p>Contracts can be oral or written, but certain details must be given in writing within 12 weeks of starting work (job title, pay, hours, leave, notice period). If you cannot read the contract language, it must be attested by a magistrate or labour officer. No contract can take away rights granted by the Act – any such term is invalid. Your contract cannot be transferred to a new employer without your consent, unless the business itself is sold.</p>

<h3>Wages and Payment</h3>
<p>Wages must be paid in cash (legal tender) unless you agree in writing to cheque or direct deposit. You cannot be forced to spend your wages at your employer's shop. Payment must be made at regular intervals – daily, weekly, fortnightly, or monthly – and within <strong>seven days</strong> after your employment ends. Only you (or someone you authorise in writing) can receive your wages.</p>

<h3>Working Hours and Overtime</h3>
<p>The standard workweek is <strong>48 hours</strong> (maximum 10 hours per day, 56 per week with agreement). If you work more than 8 hours a day or 48 hours a week, overtime is paid at <strong>1.5 times</strong> your normal rate on regular days and <strong>double</strong> on public holidays. You are entitled to a 30-minute break if your normal workday is at least 8 hours.</p>

<h3>Annual Leave, Sick Leave, Maternity and Paternity Leave</h3>
<ul>
<li><strong>Annual leave:</strong> 7 days after every 4 months of continuous service, with full pay. You cannot waive this right.</li>
<li><strong>Public holidays:</strong> You get them off with full pay; if you work, you get double pay.</li>
<li><strong>Sick leave:</strong> After one month of service, you are entitled to full pay for the first month of sickness. You must notify your employer and provide a medical certificate if requested.</li>
<li><strong>Maternity leave:</strong> Female employees get <strong>60 working days</strong> with full pay. At least 4 weeks must be taken after childbirth or miscarriage. You can return to the same or equivalent job.</li>
<li><strong>Paternity leave:</strong> Male employees get <strong>4 working days</strong> with full pay after the birth of a child or after a miscarriage.</li>
</ul>

<h3>Termination of Employment</h3>
<p>Your employment can end by notice, expiry of a fixed-term contract, resignation, or summary dismissal (for gross misconduct). The Act sets minimum <strong>notice periods</strong> based on length of service:</p>
<ul>
<li>6 months to 1 year: 2 weeks</li>
<li>1 to 5 years: 1 month</li>
<li>5 to 10 years: 2 months</li>
<li>10 years or more: 3 months</li>
</ul>
<p>Notice must be in writing and in a language you understand. You can accept payment instead of working the notice period.</p>

<h3>Unfair Dismissal and Compensation</h3>
<p>You have the right to challenge an unfair dismissal if you have worked for at least <strong>13 weeks</strong>. A dismissal is unfair if it is based on discrimination, pregnancy, union membership, filing a complaint, or if the employer failed to follow fair procedures. You must first complain to a labour officer within <strong>three months</strong>. If successful, you are entitled to at least <strong>four weeks' wages</strong>, plus up to three months' extra compensation depending on your circumstances.</p>

<h3>Severance Allowance</h3>
<p>You qualify for severance if you have worked continuously for at least <strong>six months</strong> and are unfairly dismissed, die while employed, become physically incapacitated, or your employer becomes bankrupt. The amount is negotiated between you and your employer (or through your union). If your employer deliberately refuses to pay, they face a fine of double the amount owed, paid to you.</p>

<h3>Disciplinary Procedures</h3>
<p>Your employer can give written warnings, reprimands, or suspension (up to 15 days in any 6-month period) as discipline, but only if it is reasonable. Before any dismissal, you have the right to be told the reasons in a language you understand, to bring another person to the hearing, and to have your side heard. If the procedure is not followed, you are entitled to <strong>four weeks' net pay</strong>.</p>

<h3>Rights of Vulnerable Workers</h3>
<ul>
<li><strong>Children:</strong> No child under 12 may work. Children under 14 may only do light work that does not affect schooling. Hazardous work and night work (7pm–7am) are banned for all children.</li>
<li><strong>Medical exams:</strong> Workers in hazardous jobs must undergo a medical check before starting and periodically thereafter. Results are confidential.</li>
<li><strong>Disabled workers:</strong> The Minister must make special regulations to protect their safety and fair treatment.</li>
</ul>

<h3>Complaints and Dispute Resolution</h3>
<p>If your rights under the Act are violated, you must first file a complaint with a <strong>labour officer</strong>. The officer will try to settle the matter through conciliation or mediation. If no decision is made within 90 days, you can take your case to the <strong>Industrial Court</strong>. Appeals from a labour officer's decision go to the Industrial Court on questions of law (and sometimes on facts with permission). The Industrial Court's decision is final. You can be represented by a lawyer, a union official, or an employer's organisation representative.</p>

The Employment Act protects most workers in Uganda who have a contract of service with their employer. However, it does not cover very small family businesses where the only workers are up to five dependent relatives working for the family. It also does not cover members of the Uganda People's Defence Forces (UPDF), except civilians working for the military. The government can make exceptions for certain special groups of workers, but only if they still get the same level of protection from other arrangements. Also, the Act generally does not apply to work done outside Uganda.

Section 1: Who Is Covered by Uganda's Employment Act?

Except as otherwise provided in this Act, this Act applies to all employees employed by an employer under a contract of service.

employers and their dependent relatives when dependant relatives are the only employees in a family undertaking, as long as the total number of dependent relatives does not exceed five; and

the Uganda Peoples' Defence Forces, other than their civilian employees.

The Minister may, after consultation with the Board and after taking due account of all Conventions and other international instruments ratified by Uganda, by regulations exclude from the application of all or part of this Act, limited categories of employed persons in respect of whom special problems of a substantial nature arise.

The Minister may, after consultation with the Board, by regulations exclude from the application of all or part of this Act, categories of employed persons whose terms and conditions of employment are governed by special arrangements, provided those arrangements afford protection that is equivalent to or better than the provisions of this Act from which those categories are being excluded.

Except where the contrary is provided, nothing in this Act applies to employment outside Uganda.

Application of Act

You have the right to know the precise legal meanings of words like 'employee', 'employer', and 'wages' under Uganda's Employment Act. These definitions determine who is protected by the law, what counts as employment, and how wages are calculated. For example, a 'child' is anyone under 18, and 'forced labour' is any work taken under threat. Employers and employees both need to understand these terms to know their rights and responsibilities. The Act also defines special categories like casual employees, migrant workers, and apprentices. These definitions affect everything from minimum wage to termination of employment.

Section 2: Key Definitions in Uganda's Employment Act

In this Act, unless the context otherwise requires—

"affiliated union" means any Labour Union affiliated to a Federation of Labour Unions;

"Board" means the Labour Advisory Board established by <span class="underline-gradient ref-link" data-ref="226:20">section 20</span>;


"business" includes any trade, profession, undertaking, operation or establishment, whether public, cooperative or private;

"casual employee" means a person who works on a daily or hourly basis where payment of wages is due at the completion of each day's work;

"child" means a person below the age of eighteen years;

"Commissioner" means the Commissioner in the Ministry responsible for labour;

"continuous service" means an employee's service with the same employer as defined in <span class="underline-gradient ref-link" data-ref="226:Part8">Part VIII</span> of this Act;

where there is an obligation on the employer to take all reasonable steps to ensure that the employee is taught, and acquires, the knowledge and skills of that industry, by means of practical training received in the course of the employee's employment; and

where there is a provision for formal recognition of the fact that the employee has acquired the knowledge and skills intended to be acquired when the employee has done so;

"contract of apprenticeship" means a contract of service—

"contract of service" means any contract, whether oral or in writing, whether express or implied, where a person agrees in return for remuneration, to work for an employer and includes a contract of apprenticeship;

"currency point" has the value assigned to it in <span class="underline-gradient ref-link" data-ref="226:Schedule1">Schedule 1</span> to this Act;

"dependent relative" means a member of an employee's family who substantially depends on that employee for his or her livelihood;

intellectual or psychological disability or impairment;

loss or abnormality of physiological, psychological or anatomical structural function;

reliance on a guide dog, wheelchair, or any other remedial means; and

presence in the body of organisms capable of causing illness;

"disciplinary code" means the code set out in <span class="underline-gradient ref-link" data-ref="226:Schedule2">Schedule 2</span> to this Act;

"dismissal from employment" means the discharge of an employee from employment at the initiative of his or her employer when the said employee has committed verifiable misconduct;

"employee" means any person who has entered into a contract of service or an apprenticeship contract, including, without limitation, any person who is employed by or for the Government of Uganda, including the Uganda Public Service, a local authority or a parastatal organisation but excludes a member of the Uganda Peoples' Defence Forces;

"employer" means any person or group of persons, including a company or corporation, a public, regional or local authority, a governing body of an unincorporated association, a partnership, parastatal organisation or other institution or organisation whatsoever, for whom an employee works or has worked, or normally worked or sought to work, under a contract of service, and includes the heirs, successors, assignees and, transferors of any person or group of persons for whom an employee works, has worked, or normally works;

"forced or compulsory labour" means all work or service which is extracted from any person under the threat of a penalty, including the threat of any loss of rights or privileges and for which that person has not offered himself or herself voluntarily;

"HIV" means Human Immune Deficiency Virus;

"Industrial Court" means the Industrial Court established by the Labour Disputes (Arbitration and Settlement) Act;

"labour officer" means the Commissioner or a district labour officer;

"labour union" means a labour union registered under the Labour Unions Act;

"light work" means work that is not physically, mentally and socially injurious to a child;

"migrant worker" means a person who migrates or has migrated from one country to another with a view to being employed by another person and includes any person regularly admitted as a migrant worker;

"mine" means any undertaking, whether public or private, for the extraction of any substance from on or under the surface of the earth by means involving the employment of persons underground;

"Minister" means the Minister responsible for labour matters;

"pay period" means the relevant period, whether of a day, week, fortnight or month by reference, to which an employee is entitled to receive his or her wages;

"parties" means the parties to a contract of service;

"President" means the President of Uganda;

"probationary contract" means a contract of employment, which is not of more than six months duration, is in writing and expressly states that it is for a probationary period;

"public service" means service by or for the Government of Uganda and includes persons employed in the public service, parastatal organisations and local authorities, but does not include a member of the Uganda Peoples' Defence Forces;

"qualified medical practitioner" means a Government medical officer or a registered medical practitioner;

"recruitment" includes all operations undertaken with the object of obtaining or supplying the labour of persons who do not continuously offer their services at the place of employment;

"regulations" means regulations made under <span class="underline-gradient ref-link" data-ref="226:96">section 96</span>;

"termination of employment" means the discharge of an employee from an employment at the initiative of the employer for justifiable reasons other than misconduct, such as, expiry of contract, attainment of retirement age, etc.;

"termination" has the meaning given to it under <span class="underline-gradient ref-link" data-ref="226:64">section 64</span>;

"union member" means a member of a labour union or other organisation representative of the interests of workers;

"wages" means remuneration or earnings, however designated or calculated, capable of being expressed in terms of money and fixed by mutual agreement or by national laws or regulations, which are payable under an oral or written contract of service for work done or to be done, or for services rendered or to be rendered but excluding any contributions made or to be made by the employer in respect of his or her employee's insurance, medical care, welfare, education, training, invalidity, retirement pension, post service gratuity or severance allowance;

"week" means a period of seven consecutive days.

Interpretation

You have the right to have an employment contract free from any clause that takes away your protections under the Employment Act. Any agreement that tries to limit the law's protections to your disadvantage is completely void and unenforceable. Additionally, your contract cannot stop you from filing a complaint with a labour officer, starting legal proceedings under the Act, or giving evidence in such cases. The only exception is a written settlement of a dispute that a labour officer has specifically approved as fair and reasonable. Employers cannot use these void clauses against you.

Section 3: Void Employment Contract Clauses

it excludes or limits the operation of any provision of this Act to the detriment of the employee; or

presenting a complaint under this Act to a labour officer;

initiating or enforcing any proceedings under this Act; or

giving evidence in connection with any such complaints or proceedings referred to in paragraphs (i) and (ii) unless that provision forms part of a written agreement for the settlement of a dispute that has been approved by a labour officer as fair and reasonable in all the circumstances.

You have the right not to be forced to work against your will. The law bans any person or company from using forced or compulsory labour. However, this does not apply to military service required by law, normal civic obligations like jury duty, work ordered by a court as punishment (as long as you are supervised by public authorities and not given to a private employer), or work during emergencies like war or natural disasters. Anyone who breaks this law faces a fine of up to 48 currency points (about 960,000 Ugandan shillings) or up to two years in prison, or both, plus an extra fine for each day the violation continues.

Section 4 of Employment Act prohibits forced labour. Exceptions: military, civic duties, court-ordered work (public), emergencies. Penalty: up to 48 currency points fine or 2 years jail.

Section 4: Forced Labour Prohibition in Uganda

No person shall use or assist any other person in using forced or compulsory labour.

any work or service extracted by virtue of compulsory military service laws for work of a purely military character;

any work or service which forms part of the normal civic obligations of the citizens of Uganda;

any work or service extracted from any person as a consequence of a conviction by a court of law, provided that the work or service is carried out under the supervision and control of a public authority and that the person is not hired out to or placed at the disposal of a private individual, company or association; and

any work or service extracted in cases of an emergency, such as in the event of war or disaster or threat of calamity in any circumstance that would endanger the existence or the wellbeing of the whole or part of the population.

The term "forced or compulsory labour" does not include—

Any person who contravenes this section commits an offence and is liable, on conviction, to a fine not exceeding forty-eight currency points or to imprisonment for a term of two years, or both and to a fine of four currency points for each day or part of the day on which the breach continues.

Forced labour

You have the right to be treated fairly at work regardless of your race, colour, sex, religion, political opinion, national origin, social background, HIV status, or disability. The law makes it illegal for employers to discriminate against you based on these grounds. You also have the right to receive the same pay as a person of the opposite sex if you do work of equal value. The government and courts must actively promote equal opportunities for everyone, including migrant workers who are legally in Uganda. However, an employer can require specific qualifications that are genuinely needed for the job. The government may also set limits on the jobs migrant workers can take.

Section 5: Know Your Rights Against Discrimination at Work

In the interpretation and application of this Act, it shall be the duty of all parties, including the Minister, labour officers and the Industrial Court to seek to promote equality of opportunity, with a view to eliminating any discrimination in employment.

Without prejudice to <span class="underline-gradient ref-link" data-ref="226:5:1">subsection (1)</span>, in the interpretation and application of this Act, it shall be the duty of all parties, including the Minister, a labour officer and the Industrial Court, to promote and guarantee equality of opportunity for persons who, as migrant workers, or as members of their families, are lawfully within the territory of Uganda.

Discrimination in employment shall be unlawful and for the purposes of this Act, discrimination includes any distinction, exclusion or preference made on the basis of race, colour, sex, religion, political opinion, national extraction or social origin, the HIV status or disability which has the effect of nullifying or impairing the treatment of a person in employment or occupation, or of preventing an employee from obtaining any benefit under a contract of service.

Any distinction, exclusion or preference in respect of a particular ob based on the inherent requirements of that particular job shall not be deemed to be discrimination.

The Minister may, by regulations limit the range of jobs open to migrant workers.

The Minister and the Board shall, in performing their duties, seek to give effect to the principle of equal remuneration for male and female employees for work of equal value.

Every employer shall pay male and female employees equal remuneration for work of equal value.
