Penal Code Act

<p>The Penal Code Act (Cap 128) is Uganda's primary criminal law statute. It defines what constitutes a crime, sets out penalties, and explains when you may be held responsible or excused. This Act applies to every person in Uganda, including citizens and residents, and covers acts committed both inside and outside the country in certain circumstances. Understanding its key provisions helps you know your rights, duties, and potential liabilities under Ugandan criminal law.</p><h3>Key Definitions</h3><p>The Act begins with essential definitions that apply throughout the Code. For example, a <strong>felony</strong> is a serious crime punishable by at least three years in prison or death. <strong>Night</strong> is from 6:30 PM to 6:30 AM. <strong>Grievous harm</strong> includes serious injury or permanent disfigurement. The term <strong>person</strong> includes companies and the government. These definitions are crucial for understanding your legal obligations.</p><h3>Scope and Application</h3><p>Ugandan courts have jurisdiction over crimes committed within Uganda. Additionally, certain serious offences (such as treason and piracy) can be prosecuted even if committed outside Uganda by a citizen or resident. If part of a crime occurs inside Uganda, you can be tried here for the whole act. The Code does not override other written laws, and you cannot be punished twice for the same offence.</p><h3>General Defences</h3><p>The Act recognizes several defences that may excuse criminal responsibility:</p><ul><li><strong>Ignorance of the law</strong> is generally no defence – you are presumed to know the law.</li><li><strong>Claim of right</strong>: You are not guilty of a property crime if you honestly believed you had a legal right to the property.</li><li><strong>Mistake of fact</strong>: An honest and reasonable mistake about facts can be a defence.</li><li><strong>Insanity</strong>: If a mental disease made you incapable of understanding your actions or knowing they were wrong, you may not be criminally responsible.</li><li><strong>Intoxication</strong>: Generally not a defence, but may negate intent if involuntary or if it caused insanity.</li><li><strong>Compulsion by threats</strong>: Immediate threats of death or serious harm may excuse some crimes.</li><li><strong>Self-defence and defence of property</strong>: Reasonable force is allowed under English law principles.</li></ul><h3>Offences Against the State</h3><p>Treason, inciting war against the government, and promoting war on chiefs are serious crimes, often carrying the death penalty or life imprisonment. It is also an offence to alarm, annoy, or ridicule the President. You have a duty to report knowledge of treason; failure can lead to life imprisonment.</p><h3>Offences Against Public Order</h3><p>Unlawful assemblies, riots, affray (fighting in public), and carrying weapons at gatherings are criminalised. Rioters who demolish buildings or damage property face life imprisonment. The Act also prohibits incitement to violence based on race, religion, or other characteristics, with penalties up to 14 years.</p><h3>Sexual Offences</h3><p>Rape is punishable by death. Defilement (sexual acts with a person under 18) carries life imprisonment, with aggravated defilement potentially leading to the death penalty. Indecent assault, procuration, and living on the earnings of prostitution are also serious offences. The Act protects victims and allows for court-ordered compensation.</p><h3>Offences Against the Person</h3><p>Murder and manslaughter are defined in detail. Murder requires <strong>malice aforethought</strong> (intention to cause death or knowledge that death is probable) and carries the death penalty. Manslaughter (unlawful killing without malice) is punishable by life imprisonment. Provocation, diminished responsibility, and suicide pacts may reduce murder to manslaughter. Assault, grievous harm, poisoning, and endangering life are also covered.</p><h3>Offences Against Property</h3><p>Theft, robbery, burglary, arson, and criminal damage are all defined. Theft can lead to up to 10 years in prison, with aggravated theft (e.g., stealing from a person or dwelling) carrying up to 7 years. Robbery with a deadly weapon or causing death carries the death penalty. Arson (deliberately setting fire to buildings or crops) is punishable by life imprisonment.</p><h3>Forgery, Counterfeiting, and Fraud</h3><p>Forgery of documents, wills, currency, and stamps is a serious felony. Counterfeiting coins or notes carries life imprisonment. Obtaining goods by false pretences, cheating, and issuing false cheques are also criminalised. The Act provides for forfeiture of counterfeit items and tools.</p><h3>Penalties and General Provisions</h3><p>Penalties range from fines to imprisonment to the death penalty. The Act sets default punishments for misdemeanours (up to 2 years) and attempts. Conspiracy and incitement to commit offences are also punishable. The Director of Public Prosecutions must consent to some prosecutions, and time limits apply to certain offences (e.g., 5 years for some state offences). Section 1: Key Definitions for Uganda's Penal Code Act

“court” means a court of competent jurisdiction;

“currency point” has the value assigned to it in the Schedule to this Act;

“dangerous harm” means harm endangering life;

“dwelling house” includes any building or structure or part of a building or structure which is for the time being kept by the owner or occupier for his or her residence or that of his or her family or servants or any of them, and it is immaterial that it is from time to time uninhabited; a building or structure adjacent to or occupied with a dwelling house is deemed to be part of the dwelling house if there is a communication between such building or structure and the dwelling house, either immediate or by means of a covered and enclosed passage leading from the one to the other, but not otherwise;

“felony” means an offence which is declared by law to be a felony or, if not declared to be a misdemeanour, is punishable, without proof of previous conviction, with death or with imprisonment for three years or more;

“grievous harm” means any harm which amounts to a maim or dangerous harm, or seriously or permanently injures health or which is likely so to injure health, or which extends to permanent disfigurement, or to any permanent or serious injury to any external or internal organ, membrane or sense;

“harm” means any bodily hurt, disease or disorder whether permanent or temporary;

“husband” means husband of a monogamous marriage;

“judicial proceeding” includes any proceeding had or taken in or before any court, tribunal, commission of inquiry or person, in which evidence may be taken on oath;

“knowingly”, used in connection with any term denoting uttering or using, implies knowledge of the character of the thing uttered or used;

“local authority” means a local authority established under any written law;

“maim” means the destruction or permanent disabling of any external or internal organ, membrane or sense;

“misdemeanour” means any offence which is not a felony;

“money” includes bank notes, bank drafts, cheques and any other orders, warrants or requests for the payment of money;

“monogamous marriage” means a marriage which is by law necessarily monogamous and binding during the lifetime of both parties unless dissolved by a valid judgment of the court;

"night" or "nighttime" means the interval between half-past six o'clock in the evening and half-past six o'clock in the morning;

“oath” includes affirmation or declaration;

“offence” is an act, attempt or omission punishable by law;

“person” and “owner” and other like terms when used with reference to property include corporations of all kinds and any other association of persons capable of owning property, and also when so used include the Government;

"person employed in the public service" means any person holding any of the following offices or performing the duty of the office, whether as a deputy or otherwise—

any civil office the power of appointing a person to which or of removing from which is vested in any person or in any public commission or board;

any office to which a person is appointed or nominated by any written law;


any civil office, the power of appointing to. which or removing from which is vested in any person or persons holding, an office of any kind included in paragraph (a) or (b) of this definition; or

any office of arbitrator or umpire in any proceeding or matter submitted to arbitration by order or with the sanction, of any court, or in. pursuance of any written law,

a member of a commission of inquiry appointed under or in pursuance of any written law;

any person employed to execute any process of a court;

all persons belonging to the armed forces of Uganda;

all persons in the employment of the Government or the administration of a district;

a person acting as a minister of religion of any denomination insofar as he or she performs functions in respect of the notification of intending marriage or in respect of the solemnisation of marriage or in respect of the making or keeping of any register or certificate of marriage, birth, baptism, death or burial, but not in any other respect;

"possession", "be in possession of" or "have in possession" includes not only having in one's own personal possession, but also having anything in the actual possession or custody of any other person, or having anything in any place, whether belonging to or occupied by oneself or not, for the use or benefit of oneself or of any other person; if there are two or more persons and any one or more of them with the knowledge and consent of the rest has or have anything in his or her or their custody or possession, it shall be deemed and taken to be in the custody and possession of each and all of them;

a person in the employment of an urban authority;

“public” refers not only to all persons within Uganda, but also to the persons inhabiting or using any particular place, or any number of such, persons, and also to such, indeterminate persons as may happen to be affected by the. conduct in respect to which that expression is used;

“public body” has the meaning assigned to it under section 1 of the Anti-Corruption Act;

“public place” or “public premises” includes any public way and any building, place or conveyance to which, for the time being, the public are entitled or permitted to have access either without any condition or upon condition of making apy payment, and any building or place which is for the time being used for any public, or religious meetings or assembly or as an open court;

“public way” includes any highway, marketplace, square, street, bridge or other way which is lawfully used by the public;

"publicly", when applied to acts done, means either—

“property” includes everything animate or inanimate capable of being the subject of ownership;

that they are so done in any public place as to be seen by any person whether such person is or is not in a public place; or

“utter” means and includes using or dealing with and attempting to use or deal with and attempting to induce any person to use, deal with or act upon the thing in question;

“valuable security” includes any document which is the property of any person, and which is evidence of the ownership of any property or of the right to recover or receive any property;

“vehicle” includes any kind of bicycle or tricycle;

“vessel” includes a ship, a boat and every other kind of vessel used in navigation either on the sea or in inland waters, and includes aircraft;

“wife” means wife of a monogamous marriage;

“wound” means any incision or puncture which divides or pierces any exterior membrane of the body, and any membrane is exterior for the purpose of this definition which can be touched without dividing or piercing any other membrane.

In this Code, unless the context otherwise requires—

Interpretation

Judges and legal officials must interpret the Penal Code using the same methods of legal interpretation that are used in England. Words and phrases in this Code are presumed to have the meaning they carry under English criminal law, unless the context clearly demands a different interpretation or the Code itself explicitly defines them otherwise. This rule ensures that Ugandan criminal law aligns with established English common law traditions.

Section 2: How to interpret the Penal Code Act

This Code shall be interpreted in accordance with the principles of legal interpretation obtaining in England, and expressions used in this Code shall be presumed, so far as is consistent with their context, and except as may be otherwise expressly provided, to be used with the meaning attaching to them in English criminal law and shall be construed in accordance therewith.

General rule of construction

Nothing in the Penal Code overrides other written laws in Uganda. You can still be tried and punished under other laws for offences not covered by this Code. The Code does not affect the President's power to grant pardons, remit sentences, or commute punishments. It also preserves the power of courts to punish for contempt. Laws governing the armed forces and the police remain in effect. However, if an act is punishable both under this Code and another written law, you cannot be punished twice for the same act.

The Penal Code does not affect other written laws, presidential pardons, military/police laws, or contempt powers. No double punishment for same act.

Section 3: Saving of certain laws – Penal Code does not override other laws

the liability, trial or punishment of a person for an offence against any other written law in force in Uganda other than this Code;

the liability of a person to be tried or punished for an offence under the provisions of any law in force in Uganda relating to the jurisdiction of Uganda courts in respect of acts done beyond the ordinary jurisdiction of such courts;

the power of any court to punish a person for contempt of such court;

the liability or trial of a person, or the punishment of a person under any sentence passed or to be passed, in respect of any act done or commenced before the commencement of this Code;

any power of the President to grant any pardon or to remit or commute in whole or in part or to respite the execution of any sentence passed or to be passed; or

except that if a person does an act which is punishable under this Code and is also punishable under another written law of any of the kinds mentioned in this section, he or she shall not be punished for that act both under that written law and also under this Code.

any of the written laws for the time being in force for the armed forces of Uganda or the police force established in Uganda,

Saving of certain laws

Ugandan courts have authority over crimes committed anywhere within Uganda. Additionally, they can try specific serious offences (defined in sections 23, 24, 25, and 26 of the Penal Code) even if committed outside Uganda by a Ugandan citizen or a person who ordinarily lives in Uganda. These offences are treated exactly as if they occurred inside Uganda. This means you can be prosecuted in Uganda for those crimes no matter where you committed them, as long as you are a citizen or resident.

Section 4: Ugandan courts' jurisdiction – inside and outside Uganda

The jurisdiction of the courts of Uganda, for the purposes of this Code, extends to every place within Uganda.

Notwithstanding <span class="underline-gradient ref-link" data-ref="128:4:1">subsection (1)</span>, the courts of Uganda shall have jurisdiction to try offences created under <span class="underline-gradient ref-link" data-ref="128:23,128:24,128:25,128:26">sections 23, 24, 25 and 26</span> committed outside Uganda by a Uganda citizen or person ordinarily resident in Uganda.

For the avoidance of doubt, the offences referred to in <span class="underline-gradient ref-link" data-ref="128:4:2">subsection (2)</span> committed outside Uganda by a Uganda citizen or a person ordinarily resident in Uganda shall be dealt with as if they had been committed in Uganda.

Extent of jurisdiction of courts

If you do part of a criminal act inside Uganda and the rest outside Uganda, and the whole act would be a crime under the Penal Code if done entirely in Uganda, you can be tried and punished in Uganda. The law treats you the same as if you had done everything in Uganda. This applies even if only a small part of the criminal act occurred within Uganda's borders. The court has the power to hear your case under the Penal Code for that partial act.

If you commit part of a crime in Uganda and part abroad, you can still be tried and punished under the Penal Code as if it all happened here.

Section 5: Offences partly inside and outside Uganda – jurisdiction rule

When an act which, if wholly done within the jurisdiction of the court, would be an offence against this Code is done partly within and partly beyond the jurisdiction, every person who within the jurisdiction does or makes any part of such act may be tried and punished under this Code in the same manner as if such act had been done wholly within the jurisdiction.
