Notwithstanding sections 22, 23, 24, 25 and 26, a judicial officer is entitled to the retirement benefits granted under this Part—
(a)if he or she retires on medical grounds with medical evidence to the satisfaction of the Judicial Service Commission, acting on the advice of the medical board, that he or she is unable to perform the functions of his or her office arising from infirmity of body or mind, and that the infirmity is likely to be permanent; or
(b)if he or she retires from the Judiciary Service—
(i)in the case of a Chief Justice, Deputy Chief Justice, Principal Judge, Justice of the Supreme Court, Justice of the Court of Appeal, Judge of the High Court, Chief Registrar or Registrar, with the consent of the President, acting on the advice of the Judicial Service Commission; or
(ii)in the case of a Magistrate, with the written consent of the Judicial Service Commission.
