31.Effect of theft or fraud on title of owner of converted goods

(1)Where goods have been stolen and the offender is prosecuted to conviction, the property in the stolen goods reverts to the person who was the owner of the goods or to his or her personal representative, notwithstanding any intermediate dealing with them.

(2)Where after the theft the owner loses possession of the goods, the owner or his or her personal representative may by order of the trial court, recover possession of the goods from any person for the time being in possession of the goods.

(3)Notwithstanding any enactment to the contrary, where goods have been obtained by fraud or other wrongful means not amounting to theft, the property in the goods shall not revest in the person who was the owner of the goods or to his or her personal representative, by reason only of the conviction of the offender.
