Penal Code Act

<p>The Penal Code Act (Cap 128) is Uganda's primary criminal law statute. It defines what constitutes a crime, sets out penalties, and explains when you may be held responsible or excused. This Act applies to every person in Uganda, including citizens and residents, and covers acts committed both inside and outside the country in certain circumstances. Understanding its key provisions helps you know your rights, duties, and potential liabilities under Ugandan criminal law.</p><h3>Key Definitions</h3><p>The Act begins with essential definitions that apply throughout the Code. For example, a <strong>felony</strong> is a serious crime punishable by at least three years in prison or death. <strong>Night</strong> is from 6:30 PM to 6:30 AM. <strong>Grievous harm</strong> includes serious injury or permanent disfigurement. The term <strong>person</strong> includes companies and the government. These definitions are crucial for understanding your legal obligations.</p><h3>Scope and Application</h3><p>Ugandan courts have jurisdiction over crimes committed within Uganda. Additionally, certain serious offences (such as treason and piracy) can be prosecuted even if committed outside Uganda by a citizen or resident. If part of a crime occurs inside Uganda, you can be tried here for the whole act. The Code does not override other written laws, and you cannot be punished twice for the same offence.</p><h3>General Defences</h3><p>The Act recognizes several defences that may excuse criminal responsibility:</p><ul><li><strong>Ignorance of the law</strong> is generally no defence – you are presumed to know the law.</li><li><strong>Claim of right</strong>: You are not guilty of a property crime if you honestly believed you had a legal right to the property.</li><li><strong>Mistake of fact</strong>: An honest and reasonable mistake about facts can be a defence.</li><li><strong>Insanity</strong>: If a mental disease made you incapable of understanding your actions or knowing they were wrong, you may not be criminally responsible.</li><li><strong>Intoxication</strong>: Generally not a defence, but may negate intent if involuntary or if it caused insanity.</li><li><strong>Compulsion by threats</strong>: Immediate threats of death or serious harm may excuse some crimes.</li><li><strong>Self-defence and defence of property</strong>: Reasonable force is allowed under English law principles.</li></ul><h3>Offences Against the State</h3><p>Treason, inciting war against the government, and promoting war on chiefs are serious crimes, often carrying the death penalty or life imprisonment. It is also an offence to alarm, annoy, or ridicule the President. You have a duty to report knowledge of treason; failure can lead to life imprisonment.</p><h3>Offences Against Public Order</h3><p>Unlawful assemblies, riots, affray (fighting in public), and carrying weapons at gatherings are criminalised. Rioters who demolish buildings or damage property face life imprisonment. The Act also prohibits incitement to violence based on race, religion, or other characteristics, with penalties up to 14 years.</p><h3>Sexual Offences</h3><p>Rape is punishable by death. Defilement (sexual acts with a person under 18) carries life imprisonment, with aggravated defilement potentially leading to the death penalty. Indecent assault, procuration, and living on the earnings of prostitution are also serious offences. The Act protects victims and allows for court-ordered compensation.</p><h3>Offences Against the Person</h3><p>Murder and manslaughter are defined in detail. Murder requires <strong>malice aforethought</strong> (intention to cause death or knowledge that death is probable) and carries the death penalty. Manslaughter (unlawful killing without malice) is punishable by life imprisonment. Provocation, diminished responsibility, and suicide pacts may reduce murder to manslaughter. Assault, grievous harm, poisoning, and endangering life are also covered.</p><h3>Offences Against Property</h3><p>Theft, robbery, burglary, arson, and criminal damage are all defined. Theft can lead to up to 10 years in prison, with aggravated theft (e.g., stealing from a person or dwelling) carrying up to 7 years. Robbery with a deadly weapon or causing death carries the death penalty. Arson (deliberately setting fire to buildings or crops) is punishable by life imprisonment.</p><h3>Forgery, Counterfeiting, and Fraud</h3><p>Forgery of documents, wills, currency, and stamps is a serious felony. Counterfeiting coins or notes carries life imprisonment. Obtaining goods by false pretences, cheating, and issuing false cheques are also criminalised. The Act provides for forfeiture of counterfeit items and tools.</p><h3>Penalties and General Provisions</h3><p>Penalties range from fines to imprisonment to the death penalty. The Act sets default punishments for misdemeanours (up to 2 years) and attempts. Conspiracy and incitement to commit offences are also punishable. The Director of Public Prosecutions must consent to some prosecutions, and time limits apply to certain offences (e.g., 5 years for some state offences). You cannot be tried for certain serious crimes unless the prosecution starts within five years of the offence. This time limit applies to offences under section 23 (except subsection 1(b)), and sections 24, 25, and 26 of the Penal Code Act. If the prosecution waits longer than five years, you have the right to avoid trial. This rule protects against stale accusations and ensures timely justice.

Under Section 27, for offences under s23 (except s23(1)(b)), s24, s25, s26, prosecution must start within five years. Otherwise, you cannot be tried.

Any person shall not be tried for an offence under <span class="underline-gradient ref-link" data-ref="128:23">section 23</span>, except an offence under <span class="underline-gradient ref-link" data-ref="128:23:1:b">subsection (1)(b) of that section</span>, or under <span class="underline-gradient ref-link" data-ref="128:24">section 24</span>, 25 or 26, unless the prosecution is commenced within five years after the commission of the offence.
