The term <strong>person</strong> includes companies and the government. These definitions are crucial for understanding your legal obligations.</p><h3>Scope and Application</h3><p>Ugandan courts have jurisdiction over crimes committed within Uganda. Additionally, certain serious offences (such as treason and piracy) can be prosecuted even if committed outside Uganda by a citizen or resident. If part of a crime occurs inside Uganda, you can be tried here for the whole act. The Code does not override other written laws, and you cannot be punished twice for the same offence.</p><h3>General Defences</h3><p>The Act recognizes several defences that may excuse criminal responsibility:</p><ul><li><strong>Ignorance of the law</strong> is generally no defence – you are presumed to know the law.</li><li><strong>Claim of right</strong>: You are not guilty of a property crime if you honestly believed you had a legal right to the property.</li><li><strong>Mistake of fact</strong>: An honest and reasonable mistake about facts can be a defence.</li><li><strong>Insanity</strong>: If a mental disease made you incapable of understanding your actions or knowing they were wrong, you may not be criminally responsible.</li><li><strong>Intoxication</strong>: Generally not a defence, but may negate intent if involuntary or if it caused insanity.</li><li><strong>Compulsion by threats</strong>: Immediate threats of death or serious harm may excuse some crimes.</li><li><strong>Self-defence and defence of property</strong>: Reasonable force is allowed under English law principles.</li></ul><h3>Offences Against the State</h3><p>Treason, inciting war against the government, and promoting war on chiefs are serious crimes, often carrying the death penalty or life imprisonment. It is also an offence to alarm, annoy, or ridicule the President. You have a duty to report knowledge of treason; failure can lead to life imprisonment.</p><h3>Offences Against Public Order</h3><p>Unlawful assemblies, riots, affray (fighting in public), and carrying weapons at gatherings are criminalised. Rioters who demolish buildings or damage property face life imprisonment. The Act also prohibits incitement to violence based on race, religion, or other characteristics, with penalties up to 14 years.</p><h3>Sexual Offences</h3><p>Rape is punishable by death. Defilement (sexual acts with a person under 18) carries life imprisonment, with aggravated defilement potentially leading to the death penalty. Indecent assault, procuration, and living on the earnings of prostitution are also serious offences. The Act protects victims and allows for court-ordered compensation.</p><h3>Offences Against the Person</h3><p>Murder and manslaughter are defined in detail. Murder requires <strong>malice aforethought</strong> (intention to cause death or knowledge that death is probable) and carries the death penalty. Manslaughter (unlawful killing without malice) is punishable by life imprisonment. Provocation, diminished responsibility, and suicide pacts may reduce murder to manslaughter. Assault, grievous harm, poisoning, and endangering life are also covered.</p><h3>Offences Against Property</h3><p>Theft, robbery, burglary, arson, and criminal damage are all defined. Theft can lead to up to 10 years in prison, with aggravated theft (e.g., stealing from a person or dwelling) carrying up to 7 years. Robbery with a deadly weapon or causing death carries the death penalty. Arson (deliberately setting fire to buildings or crops) is punishable by life imprisonment.</p><h3>Forgery, Counterfeiting, and Fraud</h3><p>Forgery of documents, wills, currency, and stamps is a serious felony. Counterfeiting coins or notes carries life imprisonment. Obtaining goods by false pretences, cheating, and issuing false cheques are also criminalised. The Act provides for forfeiture of counterfeit items and tools.</p><h3>Penalties and General Provisions</h3><p>Penalties range from fines to imprisonment to the death penalty. The Act sets default punishments for misdemeanours (up to 2 years) and attempts. Conspiracy and incitement to commit offences are also punishable. The Director of Public Prosecutions must consent to some prosecutions, and time limits apply to certain offences (e.g., 5 years for some state offences). If you have already been convicted of theft under certain sections of the Penal Code Act, and you commit another theft, you will be sentenced to seven years in prison. The law lists the specific prior theft offenses that trigger this harsher penalty, including stealing from a person, stealing by a clerk or servant, and embezzlement. A person accused under this section must be aware that a previous theft conviction can significantly increase their punishment. This provision is designed to deter repeat offenders by imposing a fixed, severe term of imprisonment.

If you have been previously convicted of theft under specific Penal Code sections and commit theft again, you face up to seven years imprisonment.

Section 254: Stealing after previous conviction

If the offender, before committing the theft, had been convicted of a theft punishable under any of sections <span class="underline-gradient ref-link" data-ref="128:244">244</span>, <span class="underline-gradient ref-link" data-ref="128:245">245</span>, <span class="underline-gradient ref-link" data-ref="128:246">246</span>, <span class="underline-gradient ref-link" data-ref="128:247">247</span>, <span class="underline-gradient ref-link" data-ref="128:248">248</span>, <span class="underline-gradient ref-link" data-ref="128:249">249</span>, <span class="underline-gradient ref-link" data-ref="128:250">250</span>, <span class="underline-gradient ref-link" data-ref="128:252">252</span> and <span class="underline-gradient ref-link" data-ref="128:253">253</span>, he or she is liable, on conviction, to imprisonment for a term of seven years.
